CONSUMER-SPECIFIC MANDATORY NOTICES

1. Identity of the Contracting Party
The Platform is operated by Nerqis Ltd ("Nerqis" or the "Company"), which makes the Platform available to Users and provides access to AI-powered testing services and related digital services through it.
Where subscription purchases are made through the Platform, the relevant payment transaction is processed by an authorised third-party payment processor in accordance with its own applicable terms and conditions.
Accordingly, purchases made through the Platform may also be subject to the applicable terms, conditions, billing procedures and refund mechanisms of the relevant payment processor.
2. Main Characteristics of the Service
The Platform provides access to AI-powered software testing tools, including automated test case generation, test management, test execution, result reporting, and related features. Users may subscribe to a Plan to access features and usage limits as described on the Platform.
Access to the Platform's Services is granted under a limited, non-transferable, non-exclusive licence for internal business use, subject to the Platform's Terms and Conditions.
No ownership rights in the Platform's underlying software, AI models, or proprietary algorithms are transferred to Users. All intellectual property rights remain vested in Nerqis Ltd.
Access to the Services may be subject to availability, technical compatibility requirements, geographic limitations, and compliance with Platform rules.
The Company reserves the right to update, modify, or restrict features of the Platform in accordance with its contractual and legal obligations.
3. Pricing, Taxes and Payment
Prices for subscription Plans and any paid features of the Platform shall be displayed to Users through the Platform prior to purchase. The relevant transaction shall be processed by the applicable payment processor in accordance with its own terms and conditions. Accordingly, billing, payment processing, applicable taxes, cancellations and refunds in respect of such purchases may be subject to the terms, policies and procedures of the relevant payment processor.
4. Right of Withdrawal and Waiver for Digital Services
Where subscriptions or access to paid Services are obtained through the Platform, any request for cancellation, withdrawal, refund or repayment relating to such purchase shall be made in accordance with the applicable Terms and Conditions and the terms of the relevant payment processor, subject always to any mandatory rights available to Users under applicable law. Nothing in these documents shall exclude or limit any non-waivable consumer rights.
5. Conformity of Digital Services
The Company is the operator of the Platform and the provider of the digital services made available through it. The Company shall use reasonable skill and care to ensure that such services conform to the description provided and comply with applicable law. Users may have mandatory statutory rights and remedies in the event of any lack of conformity, defect, failure to supply or other non-compliance affecting the digital services.
6. Technical Requirements and Compatibility
Access to the Platform requires a compatible web browser, internet connectivity, and a supported operating system version.
Users are responsible for ensuring that their system meets the minimum technical requirements disclosed by the Platform.
The Company shall not be liable for service interruptions arising from system incompatibility, third-party service outages, internet connectivity failures, or other external factors beyond the Company's reasonable control.
7. Updates and Modifications
Where necessary to maintain conformity, security, or improve functionality, the Company may provide updates to the Platform's Services and AI Features.
Users may be required to accept updates to continue accessing certain features.
Where modifications materially affect access to subscribed Services, such changes shall be implemented in accordance with applicable law and without prejudice to statutory consumer rights.
8. Duration and Termination
User accounts remain active until terminated by the User or the Company in accordance with the Terms and Conditions.
Access to the Services is subject to continued compliance with Platform rules and may be suspended or terminated in cases of breach.
Termination for serious breach may result in suspension of access without refund where permitted by applicable law.
Nothing in the Terms limits statutory rights of consumers.
9. Complaint Handling and Redress
Users may submit complaints to the Company in relation to the operation of the Platform, access to Services, moderation decisions, technical issues, account matters, or the conformity of the digital services provided through the Platform, using the contact details set out in these documents. Where a complaint relates specifically to billing, payment collection, cancellation, or refund processing concerning a subscription purchase, such complaint may also be subject to the applicable procedures of the relevant payment processor.
10. Advertising Transparency
Where advertising or sponsored content is displayed on the Platform, Users shall be clearly informed of the commercial nature of such communications in accordance with applicable law.
Where targeted advertising is used, Users shall be provided with meaningful information regarding the main parameters used to determine advertisement display.
Advertising practices are governed by the Platform's Advertising & Sponsored Content Policy.
11. Data Protection
Personal data is processed in accordance with the Privacy Policy and applicable data protection legislation.
Where advertising or profiling involves processing of personal data, such processing shall be based on a lawful basis under the General Data Protection Regulation.
Users retain their rights under GDPR, including the right to access, rectify, erase, restrict processing, object, and lodge a complaint with a supervisory authority.
12. Mandatory Consumer Rights
Nothing in the Platform's Terms, policies, or agreements shall exclude, limit, or waive any mandatory rights granted to consumers under European Union or Cyprus law.
In the event of any inconsistency between contractual provisions and mandatory consumer protection legislation, the latter shall prevail.
